Heat SMS Terms
This Heat SMS module supplements the applicable terms. It does not replace the complete corporate, consumer discount or restaurant partner agreement.
1. About these SMS programs
Heat is a service operated by OCUS SAS, 43 rue d'Aboukir, 75002 Paris, France. These SMS terms describe two separate programs: Heat Leads, for restaurant owners interested in Heat, and Heat Discounts, for consumers requesting a participating restaurant's discount code. The consent and messages described for one program do not authorize messages under the other program.
Read the section for the program you join together with the common terms below and the applicable Privacy Policy.
2. Common SMS terms
Messages may be sent using automated technology. Your SMS consent applies to the program and purposes presented when you sign up. Accepting general terms does not, by itself, establish consent to receive marketing SMS.
Consent to receive SMS is not a condition of purchase. Mobile information, including SMS opt-in data and consent, is not sold or shared with third parties for their own marketing or promotional purposes. See the applicable Privacy Policy.
You can opt out of the SMS program by replying STOP. For help, reply HELP or contact viral@ocus.com. Message and data rates may apply. Delivery depends on your mobile service and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages.
3. Heat Leads: restaurant owners
Heat Leads sends commercial messages about Heat to restaurant owners who choose to receive them through the dedicated SMS marketing consent option.
The program covers up to two marketing follow-up messages, plus replies to your messages. This consent covers commercial communications only. It does not cover appointment reminders or appointment-related communications.
The SMS marketing consent option is optional and unchecked by default.
4. Heat Discounts: consumers
You must be at least 18 years old, or the age of majority where you live, and be the account holder of the mobile number you provide or have the account holder's permission to use it.
Program name: Heat. By accepting these Terms and clicking “Reveal my code” on a Heat discount page, you agree to receive one automated marketing text message from Heat with your welcome code.
By clicking “Reveal my code”, you also agree to receive recurring automated marketing text messages from Heat at the mobile number you provided, with future offers from the restaurant where you claimed your code.
Recurring offer frequency varies. Reply STOP to stop messages or HELP for assistance. You can also contact viral@ocus.com.
Offers under this program must not promote alcohol or tobacco. Any offer-specific redemption conditions shown with your code or offer also apply.
5. Heat Discounts: existing offer conditions retained
Each offer is set by the participating restaurant and described on its Heat discount page. One code per person per offer. If you claim the same offer again with the same email address or phone number, you receive the code already issued to you.
Offers are limited: an offer can reach its maximum number of codes, and the restaurant can end it at any time. Once an offer ends, no new codes are issued and existing codes may stop working.
Codes are redeemed at the participating restaurant when you order. They have no cash value, cannot be exchanged, transferred or sold, and cannot be combined with other offers unless the restaurant allows it. We may cancel codes obtained through fraud or abuse, or in breach of these terms.
Offers are made by participating restaurants. Each restaurant is responsible for honouring its offer and for the food, drinks and services it provides. Heat is not responsible for a restaurant's products, services, prices, opening hours or availability.
You agree not to claim offers with contact details that are not yours, create several identities to obtain more than one code, interfere with the Heat discount pages, or use them for any unlawful purpose.
